Official Contest Rules
Iowa Credit Union League Member of the Game Contest
1. SPONSOR. The Member of the Game Contest (“Contest”) is sponsored by the Iowa Credit Union League (“Sponsor”), and administered by Choice Creative Solutions (“Agency”).
2. ELIGIBILITY. The Contest is open to those who are at least 18 years old at the time of entry, hold a valid state issued form of identification, are a member of a credit union with a branch located in the State of Iowa as of August 1, 2024 and have provided a story describing the impact on their life made by their credit union membership. Prior to contacting a winner, Sponsor will contact the credit union identified by the entrant to confirm credit union membership. If membership is not confirmed, the entrant is not eligible. Employees and immediate family of Sponsor and Agency, as well as their affiliates, Iowa credit unions and affiliates of Iowa credit unions are not eligible for the Contest. Immediate family means spouse, child, parent of each employee. The Contest is subject to federal, state, and local laws and regulations. Void where prohibited by law.
3. AGREEMENT TO OFFICIAL RULES. Participation in the Contest constitutes entrant’s full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor, which are final and binding. Winning the Contest is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. Sponsor reserves the right to disqualify an entrant if the Official Rules are violated in any way. Official Rules are available during regular business hours at Agency’s location: 6163 NW 86th St, Suite 105, Johnston, IA 50131 and on the Contest website, www.memberofthegame.com. Official Rules are subject to change without notice.
4. CONTEST PERIOD. The Contest entry period begins at 12:01 am CST on August 1, 2024, and ends 11:59 pm CST on November 16, 2024. Entries made before or after the official Contest period will be disqualified. Entries will be accepted for the duration of the Contest period. Each Entry End Date for each of the Prizes will end two (2) weeks before the game day for that Prize. See schedule above. Entries received as of the applicable Entry End Date will be considered for the selected team’s home football game associated with that Entry End Date. Unsuccessful entries will automatically roll-over and be considered as entries for the remaining games of the selected team during the Contest period.
5. HOW TO ENTER. Entrants will receive one entry in the Contest by filling out the online entry form at www.memberofthegame.com. Alternatively, if entrants do not enter on the Contest website, they may request a paper entry form by sending a request with their name and address to: Choice Creative Solutions, Attn: Member of the Game, 6163 NW 86th Street, Suite 105, Johnston, Iowa 50131. A fully complete paper entry form must be received by the Contest End Date to qualify for entry. Neither Sponsor nor Agency are responsible for any delays including but not limited to processing the paper entry form request or due to mail. All entries become the property of Sponsor. All entrants are required to provide Sponsor with their legal name (first and last), e-mail address (if applicable), telephone number, mailing address current credit union where membership is maintained, and a written story describing the impact on their life made by their credit union membership. By entering the Contest, all entrants agree the Sponsor may use his/her first name and last name (or last name initial) and credit union affiliation for promotional purposes in public announcements of the Contest winner, including but not limited to social media, Contest website, radio announcements and press releases. By submitting an entry, entrant agrees in conjunction with the first name and last name (or last name initial) and credit union affiliation, Sponsor may also use entrant’s story submitted in the contest entry (in whole or part), photograph and/or likeness for promotional purposes and waives any claim of royalty or right of further remuneration for any such promotional use. The Sponsor, Agency and their respective directors, officers, employees and members assume no responsibility for incorrect, invalid, terminated or non-functioning emails or lost, incomplete, late, illegible or undelivered entries. NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN. The Contest is void where prohibited by law. Entries generated by script, macro or other automated means are void.
6. PRIZE. For each game identified in Section 4, the winner will be publicly identified as the “Member of the Game” and the prize will be four (4) tickets to the game for the entrant’s preferred team on a game date determined by Sponsor (“Prize”). Retail value of the Prize fluctuates based on the game but is approximately $300.00. There is no cash prize or alternative Prize. If the winner is unable to attend the selected game, the Prize is forfeited and Sponsor will select another winner, and as Sponsor’s sole discretion, the submission may be considered as an entry for another game. The Sponsor and Agency, and their respective parents, subsidiaries, affiliates, and other companies associated with the Contest make no claims of merchantability of the Prizes. The Prize is intended solely for the winner and winner’s three (3) guests. If the winner is unable to use the Prize, the Prize shall be returned to Sponsor. No portion of the Prize shall be sold or otherwise transferred to anyone other than the winner. Winner is responsible for all expenses, other than four (4) tickets, related the Prize, including but not limited to transportation, parking, lodging and meals. The Prize
may not be redeemed or exchanged if the winner is unable to attend the game that is the subject of the Prize. There will be no substitutions if the winner is unable to use or accept the Prize. If any portion of the Prize is cancelled or postponed for any reason, no Prize will be provided in lieu thereof, nor will Sponsor award an alternate prize. Prizes may be subject to certain terms and conditions as specified by the issuer of the Prize.
7. CONTEST ODDS. The odds of being selected as the winner depend on the number of entries into the Contest. If 1,000 entries are made and only a single entry is made by each entrant, the odds of being a winner are 1:1,000. 8. PRIZE DETERMINATION. The winners of the Prizes will be determined within one (1) week of the Entry End Date, at which time the winners will be contacted using either the email address or phone number provided with the entry. A winner will be selected from entrants submitted as of the applicable Entry End Date and based on the team identified in the entry (for example, entries selecting Iowa State University will be considered for a Prize associated with the Iowa State University games). Stories will be reviewed by the Sponsor and Sponsor will select winners based on the completeness of their entry and the impact of credit union membership on the entrant’s life.
9. WINNER NOTIFICATION. The first name, first initial of last name and associated credit union of the winners may be placed on the Contest website following contact of the winner. The winners will have until the end of day the following business day after they have been notified to claim their Prize. If either the Sponsor Agency is unable to contact the Winner either through undeliverable message or non-response within the allotted time period, the Prize is forfeited and another winner will be determined. The Agency will coordinate with winner to distribute the prize, which may include picking up tickets at a credit union branch or receiving electronically. If a winner declines the Prize, the Sponsor will select another winner. If the Sponsor is unable to determine a winner to accept a Prize or the Prize is not claimed by the day of the game, the Sponsor may donate the unclaimed Prize for educational, civic, public, or charitable use. By claiming the Prize, the winner releases the Sponsor, Agency and their officers, directors, members, employees, subsidiaries, and affiliates from any and all claims, liabilities, and/or damages arising directly or indirectly out of the Contest and/or use of the Prize. The Sponsor, Agency and their officers, directors, members, employees, subsidiaries and affiliates are not responsible for illness, death or injury which may be sustained in conjunction with participation in the contest and/or the use of the Prize.
10. GENERAL CONDITIONS. In the event the operation, security, or administration of the Contest is impaired in any way, for any reason, including but not limited to fraud or unauthorized human intervention or other technical problems, or in the event the Contest is unable to run as planned for any other reason, as determined by the Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of the Official Rules or b) suspend the Contest in its entirety. The Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of the legitimate operation of the Contest. Such activities may be a violation of criminal and/or civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of the Official Rules shall not constitute a waiver of that provision. Decisions of the Sponsors are final.
11. RELEASE, LIMITATIONS OF LIABILITY, INDEMNITY. Contest entrants agree to release and hold harmless the Sponsor, Agency and their respective parents, subsidiaries, affiliates, other companies or entities associated with the Contest and Prize, and each of their respective officers, directors, employees, shareholders, representatives, and agents (“Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt and/or use of a Prize. This includes but is not limited to: a) technical errors associated with the Contest, such as lost, interrupted, or unavailable Internet Service Provider (ISP) access, or network, server, wireless service provider, or related connection errors. Said technical errors may also include the unavailability, limited accessibility, or miscommunication of a failed computer, satellite, telephone, cellular tower, or cable transmission line, or a technical failure or jumbled, scrambled, delayed, or misdirected transmission or computer hardware or software malfunction, or failure; b) unauthorized human intervention in the Contest; c) mechanical, electronic, human, and printing and/or typographical errors; d) application downloads and/or failures; e) any other errors or problems pertaining to the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the Prize, or the incorrect downloading and processing of entries or any Contest related materials; f) injury, death, loss, or damage of any kind, to persons and/or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest or acceptance, receipt, or misuse of a Prize (including any travel or activity related thereto). Entrants further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall an entrant be entitled to receive attorney’s fees; and/or g) incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. The Sponsor and Agency expressly disclaim any responsibility and entrants agree to indemnity and hold harmless the Sponsor and Agency, including their Released Parties from and against any and all claims, actions, demands and/or liabilities for injury/death, damage or loss to any person or property relating to or arising in connection with participation in the Contest (regardless of the cause of such injury or loss), the delivery and/or subsequent use or misuse of the Prize and/or printing, distribution or production errors. Winner acknowledges the Prize is awarded ‘as is’ and Sponsor has not made, and is not in any manner responsible or liable for any representation, guarantee or warranty, expressed or implied, relative to the Prize, including but not limited to its quality, condition or fitness for a particular purpose.
12. DISPUTES. Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Polk County, Iowa. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor or Agency in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Iowa, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Iowa.
13. FINANCIAL OBLIGATION. The winner assumes the financial obligation for local, state and federal taxes and all applicable fees based on the value of their Prize. In accordance with IRS regulations, the Prize winners will be furnished an IRS Form 1099 (miscellaneous income). For additional information, winners should consult their tax advisor. The winner will be entirely and solely responsible for paying any such taxes. No other fees, taxes and/or penalties will be paid by the Sponsors in connection with the Contest unless specifically outlined in these rules
